Real Estate.

Our real estate practice is as varied as our clientele.  We represent Buyers, Sellers, refinances, and Financial Institutions regarding review and drafting of purchase & sale agreements, loan and refinance documents, and title matters.  Our representation includes review and preparation of easements as well as licenses and similar real estate interests, including liens.  Title insurance, title disputes, and escrow matters are also handled by Cook & Bartlett.  Our attorneys also review and draft commercial and residential leases and assist with real estate development.

We represent plaintiffs and defendants in a variety of litigation contexts, including enforcement and defense of Purchase & Sale Agreement disputes, boundary line litigation, easement disputes, and prosecuting foreclosure matters.  Our practice includes commercial landlord and tenant matters, and representing residential landlords.  We represent both unit owners and associations in Home Owner Association (HOA) disputes.

We offer our clients broad-based real estate legal advice and representation in the following transactions:

  • Residential & Commercial Real Estate Sales Transactions

  • Residential & Commercial Closings

  • Construction Contracts

  • Residential & Commercial Leases

  • Residential & Commercial Mortgage-Based Financing Transactions

In addition to real estate transactions, we assist with the following residential and commercial real estate issues:

  • Land use

  • Easements

  • Zoning

  • Permit appeals

  • Tax-Free Exchanges

  • Foreclosures

  • Real Estate Tax Protests

  • Breach of contract

  • Buyer-seller disputes

  • Landlord-tenant disputes

  • Evictions/Unlawful Detainer Actions

COVID-19 Update: After the eviction moratoria are lifted, Clark, King, Pierce, Snohomish, Spokane, and Thurston Counties will all require landlords to give tenants the option of participating in the Eviction Resolution Program (ERP), an alternative dispute resolution process, before commencing an unlawful detainer proceeding.  Even after offering participation in the alternative dispute resolution process, under the ERP there are certain requirements that landlords must comply with in beginning an eviction proceeding; our firm is ready to assist landlords or tenants through this new process.
